Welcome to Baka's Internet web site (the "Site"). This Site contains text, images, audio clips, video clips, software and other materials (collectively, the "Content"), provided by Baka Communications, Inc. (collectively, "Baka") for informational purposes only. By accessing the Site or downloading any Content, you agree to be bound by the Terms of Use set out below ("Terms of Use"). If you do not agree to these Terms of Use, do not access the Site or any Content.

Please note that we reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms of Use at any time. Please check periodically for changes. Your continued use of the Site following the posting of any changes to these Terms of Use will mean you accept those changes.

Placing your order and/or the use of your device constitutes the understanding and acceptance of ALL Terms and Conditions of both Baka and Bell Mobility.

Baka is not responsible for electronic errors that result in delays or errors in processing your order. Credit card numbers are required for credit checks. Even when purchasing a "zero-dollar" device a credit check must be completed. Customers must pass the Bell credit check process in order to receive the device(s). Should a credit issue or request for additional information arise during the processing of your order, this must be resolved within 3 business days or your order will be canceled. Please allow a minimum of 7 business days for the receipt of your order, pending the accuracy of all provided information and also the results of the credit assessment. We ship all devices via courier; Monday to Friday between the hours of 8am to 5pm. The courier will require a signature upon delivery, provide us with an address where someone will be in attendance during these hours. If there is no one available to sign for your package, it may be held at the courier and you will need to contact us to make alternate arrangements. We ship overnight within Ontario and via ground or air within Canada. Ground may take up to 6 business days, depending on your location. Since your phone is active when shipped, Baka cannot provide a credit for any days of lost service while your phone is in transit. You must be 18 years of age or older at time of purchase.

Baka, Baka Wireless and Baka Mobile are registered trademarks of Baka Communications, Inc., and may appear throughout sections of this website. For the purposes of these Terms and Conditions, Baka, Baka Mobile, Baka Wireless refer to Baka Communications, Inc.

By uploading materials to any chat board or forum available on the Site ("Forums") or otherwise submitting any materials to us on the Site (collectively such materials and content being "User Content"), you automatically grant (or warrant that the owner of such User Content expressly grants) Baka a world-wide, perpetual, royalty-free, irrevocable and non-exclusive right and license to use, copy, adapt, transmit, communicate, publicly display and perform, distribute and create compilations and derivative works from such User Content, for the purposes of publishing and promoting such User Content in connection with the Forum through which the User Content was submitted or generated, and for all promotions thereof, as well as for any other purposes permitted under its Privacy Policy, all without attribution or compensation to you. Such license shall apply with respect to any form, media, or technology now known or later developed. In addition, you warrant that all "moral rights" in such User Content has been waived.

Baka is not responsible for any loss, damage, or corruption that may occur to your User Content and Baka bears no responsibility for maintaining the accuracy or confidentiality of your User Content.

If you are a minor, you must have permission from your parent or guardian to upload any User Content to a Forum. Baka may request a parent's or guardian's email address from anyone who uploads any User Content to a Forum for the purpose of verifying with the parent or guardian that he/she has in fact given permission for such uploading. In the event that User Content is uploaded without permission, any or all uploaded User Content may be removed immediately and without notice to you.

Baka may at any time and without notice remove any User Content and may in its sole discretion refuse to delete any User Content.
